When submitting a school club application, research funding application, or fundraising proposal, we may collect additional information about your proposal, such as the associated school or company, personal information of other individuals involved, and your title and contact information. If participating in our third-party honorees program, we may collect medical information, such as the honoree's health conditions. Please refrain from sending confidential health information directly through the Website or to contact email addresses listed on the Website.

We will not send donor mailings on behalf of other organizations unless we have the donor's explicit permission to do so. You understand, acknowledge, and agree that the operation of certain areas of the Site may require or involve the submission, use, and dissemination of various personal information.

6. Donors; Donations:

By donating money through the Site, you represent and warrant that you are authorized to make such payment and use the selected payment method, and you authorize BCF (or our third-party payment processor) to charge your payment method for the total amount of your donation. You acknowledge and agree that BCF makes no representation as to whether your donation is personally tax deductible or eligible for tax credits. Furthermore, you acknowledge and agree that: (a) all donations to BCF support BCF's collaborative cancer research programs and donations may not be further restricted to any particular purpose; (b) designated donations and any applicable transaction fees will be charged to the credit or debit card or other payment method you designate; (c) all payments will be processed through BCF's designated third-party payment processor, and BCF does not directly collect or store your credit card information; and (d) all processed donations may be final and non-refundable.

7. Feedback:

BCF welcomes your feedback and suggestions about BCF, BCF services, or how to improve the Site. By transmitting any suggestions, information, material, or other content (collectively, "Feedback") to BCF, you represent and warrant that you own all rights to such Feedback and that the Feedback does not infringe the rights of any third party. In addition, when you submit Feedback, you irrevocably assign all right, title, and interest in the Feedback to BCF and waive in favor of BCF, its successors, and assigns any and all moral rights that you have or may have in the Feedback. You also agree to provide BCF with any assistance it may require to document, perfect, and maintain BCF's rights to the Feedback. 8. User Communications and Submissions:

The Site may occasionally enable users to post content or engage in communications by submitting materials such as comments, remarks, responses, suggestions, ideas, graphics, opinions, photos, or other information (collectively, "Submission(s)"). Furthermore, if you opt to make a donation in honor or memory of an individual, BCF may facilitate sending a digital or physical card or message to another individual (collectively, "Message(s)"). Submissions and Messages should reflect your genuine opinions, findings, beliefs, or experiences. As personal medical information is often sensitive, BCF requests you to exercise caution in selecting information to include in Submissions or Messages. By providing a Submission or Message, you agree not to upload, post, display, transmit, or send any of the following:

  • Content that defames, harasses, abuses, stalks, threatens, discriminates, intimidates, or violates others' rights;
  • Unauthorized copyrighted materials or any material that infringes others' intellectual property rights, trade secrets, or privacy;
  • Content that promotes criminal conduct or would result in civil liability, or violates any law or regulation in any jurisdiction;
  • Vulgar, obscene, profane, or objectionable language or images that are generally considered inappropriate in social or professional settings;
  • Impersonations of any person or entity, including BCF employees and representatives; • Misrepresentation of your affiliation with any entity or BCF;
  • Violation of privacy or publicity rights, including posting medical or personally identifying information of others;
  • Unlawful content;
  • Junk mail, spam, or unsolicited/unauthorized commercial electronic messages, advertising, or promotional materials;
  • Off-topic content; or
  • Files containing malicious code, viruses, or similar software or programs that may harm or damage others' computers, networks, or the Site.

By sending a Message, you warrant that you possess all necessary rights to send the Message's content and the recipient's consent to receive it. You acknowledge that you, not BCF, are the sender, and BCF merely serves as a delivery agent on your behalf.

By posting a Submission, you grant BCF a non-exclusive, worldwide, fully paid-up, royalty-free, perpetual, irrevocable, transferable, assignable, and unlimited license to use, reproduce, transmit, display, sublicense, and create derivative works from your Submission in connection with the Site and for any lawful purpose. You waive any moral rights you may have in the Submission in favor of BCF, its successors, and assigns. You represent that you have all necessary rights to make the Submission available to BCF.

BCF does not become a publisher of your Submission by merely allowing it to be collected through or appear on the Site; BCF functions as an intermediary, enabling you to provide and display your Submission. You acknowledge that BCF has no control over the extent to which any idea or information may be used by any party or person once you post or display it in a public area of the Site (or permit such posting or display, including through sending a Message).

9. User Information and Conduct:

You agree not to harvest, collect, use, or store any information (including personal information) about other users of the Site, such as email addresses, without their express consent. BCF does not pre-screen Submissions or Messages and encourages users to exercise discretion and caution when evaluating or reviewing them. BCF does not endorse, oppose, or edit any user's opinion or information and makes no representation or endorsement regarding the accuracy, acceptability, completeness, timeliness, or reliability of any advice, opinion, statement, or other material displayed, uploaded, or distributed by users. However, BCF reserves the right to delete or take other action with respect to Submissions (or parts thereof) or Messages that BCF believes in good faith violate this TOS and/or are, or are potentially, unlawful or harmful to BCF or its affiliates, volunteers, services, or goodwill. 10. Funding Opportunities:

BCF supports alternative cancer research and may occasionally invite you to respond to Calls for Ideas (CFIs), Requests for Proposals (RFPs), or apply for research grants through the Site (collectively, "Funding Opportunity(ies)"). By submitting any content or materials (collectively, "Proposal(s)") in response to a Funding Opportunity, you grant BCF and its partners the right to use, review, and share your Proposal. You acknowledge and agree that your Proposal is subject to and will conform to the specific requirements and terms set forth in the Funding Opportunity. You are solely responsible for rights clearance and accuracy, and you represent and warrant that you own all rights, title, and interest in or to the Proposal or have the full right, power, and authority to grant the rights granted herein. You also represent and warrant that you are not aware of any investigation, claim, or litigation involving the Proposal; the Proposal does not violate or infringe the rights of any other party or the laws or regulations of any government or judicial authority; the Proposal is accurate to the best of your knowledge, and the Proposal does not include any libelous, defamatory, or unlawful materials. BCF and its partners are under no obligation to review, select, use, accept, or fund your Proposal.

11. Copyright and Designated Agent for Notification of Claims of Infringement:

BCF respects the intellectual property of others and expects its users to do the same. In compliance with U.S. Copyright Law and the Digital Millennium Copyright Act (DMCA), BCF may remove or disable access to content or material claimed to be infringing and/or terminate any rights to access and use the Site. If you believe that one or more of your works have been copied in a way that constitutes copyright infringement, please provide a written notice of your claim of copyright infringement directed to BCF's Designated Agent as specified below, along with the following information:

Unless prohibited by applicable law, this Terms of Service (TOS) shall be governed and enforced in accordance with the laws of the State of Wyoming, without regard to its choice of law principles.

18. Ensuring Site Security:

BCF strives to maintain the Site as a secure and productive resource. As such, you are prohibited from using the Site or any of BCF's data, systems, network, or services to engage in or promote illegal, abusive, or irresponsible behavior. To uphold security, BCF reserves the right to view, monitor, and record activity on the Site. Law enforcement organizations may review any recorded activity. BCF will comply with all court orders or subpoenas involving requests for information to the extent required by applicable law. BCF reserves the right to suspend or terminate access to the Site or any portion thereof when warranted.

19. Injunctive Relief:

You acknowledge that, in addition to other remedies, BCF is entitled to seek and be awarded an injunction or other equitable relief from a court of competent jurisdiction to restrain any breach or potential breach of your obligations under any provision of this TOS. Consequently, you waive any requirement for BCF to post a bond or other security in the event injunctive or equitable relief is sought or awarded to enforce any provision of this TOS.

20. Term & Termination:

This TOS becomes effective when you agree to the Site's terms and conditions, register, respond to a request for information through the Site, or begin downloading, accessing, or using the Site, whichever occurs first. BCF reserves the right to deny your access to the Site or any portion thereof on reasonable grounds. This TOS also automatically terminates if you fail to comply with its terms and conditions, with certain provisions surviving as identified below. Termination is effective without prior notice. You may also terminate this TOS at any time by ceasing to use the Site, but all applicable provisions will survive termination. Upon termination, you must destroy all copies of any aspect of the Site in your possession. Provisions regarding Submissions, BCF's proprietary rights, Feedback, disclaimers, limitations of liability, governing law, waiver and severability, and injunctive relief will survive the termination of this TOS for any reason.

21. Waiver & Severability:

Failure to insist on strict performance of any terms and conditions of this TOS will not constitute a waiver of any subsequent default or failure of performance.
